- Do not upload personally identifiable student records (names, IDs, grades, IEPs, health info).
- Do not upload content you do not have rights to submit.
- Do not attempt to reverse engineer, scrape at scale, or interfere with the Service.
- Do not use the Service to generate unlawful, harassing, deceptive, or harmful content.
- Do not present audit outputs as guarantees of correctness, compliance, or student outcomes.
Detailed rules — including prohibited content, copyright, automation, and enforcement — live in our Acceptable Use Policy, which forms part of these Terms.
5. Your content
5a. Data protection & user role (GDPR / CCPA / COPPA)
The Service is intended for educators, coaches, and curriculum staff who are 18 years of age or older. It is not directed to children under 13 and is not intended for direct use by students. You agree not to upload personally identifiable information about students, including names, student IDs, grades, IEPs, or health information. This commitment supports our position under the U.S. Children's Online Privacy Protection Act (COPPA).
For content you do upload, you represent and warrant that you have the legal basis to share it with us for processing — including, where applicable under the EU/UK General Data Protection Regulation (GDPR), a lawful basis for any personal data contained in your uploads. With respect to such personal data, ExcelUp Lab acts as a processor on your behalf and you act as the controller; we will process it only to operate the Service for you and in accordance with our Privacy Policy.
We do not sell or "share" personal information for cross-context behavioral advertising as defined by the California Consumer Privacy Act (CCPA/CPRA). Your statutory rights of access, deletion, correction, and portability — and how to exercise them — are described in the Privacy Policy. If you require a data processing addendum (DPA) or standard contractual clauses (SCCs) for an institutional deployment, contact privacy@exceluplab.com.

8. Plan limits & acceptable use
Each plan includes a defined monthly audit allowance. Usage above your plan's cap is blocked until the next monthly reset or until you upgrade.
Current monthly allowances:
- Free: 5 audits per user per month.
- Pro: 200 audits per user per month.
- Coach: 450 text audits per month pooled across the team, plus 50 visual / scanned-document audits per team owner.
The following uses are prohibited regardless of plan and may result in throttling, additional charges, or account suspension:
- Automated, scripted, or programmatic audit submission.
- Sharing a single seat across multiple people or organizations.
- Reselling, white-labeling, or sub-licensing audit outputs without a written agreement.
- Bulk processing of third-party catalogs or curricula on a consumer plan.
- Attempting to evade plan caps, rate limits, or seat boundaries.
If your needs exceed the Pro or Coach cap, contact us about a School or District plan or a custom agreement. Accounts showing signs of abuse, automation, or evasion of limits may be rate-limited or suspended.

10. Termination & post-termination retention
You may delete your account at any time from Settings → Danger Zone. We may suspend or terminate accounts that violate these terms, create risk for other users, or are inactive for an extended period. Upon termination, your right to use the Service ends; certain provisions (ownership, disclaimers, limitation of liability, indemnity, governing law) survive.
Account deletion removes your profile and uploaded materials from active systems, but some data is retained after termination where we have a legal or compliance obligation:
- Billing, tax, and transaction records — up to 7 years.
- Security and audit logs — up to 2 years.
- Encrypted backups — purged on a rolling 35-day cycle.
- DMCA notices, counter-notices, and the minimum identifiers needed to enforce our repeat-infringer policy under 17 U.S.C. § 512 — up to 3 years, even if the associated account has been deleted. A deleted account cannot be restored, including after a successful counter-notice.

You are responsible for ensuring you have the necessary rights, licenses, or permissions for any content you upload — including textbooks, publisher lessons, proprietary assessments, and other third-party copyrighted materials. By uploading, you represent that your use is authorized or otherwise permitted by law. ExcelUp Lab does not vet uploads for copyright status and is not a party to your licensing arrangements with publishers or content providers.
If you are a copyright owner and believe content on TrustEd Nav infringes your rights, please follow the takedown process in our Copyright & DMCA Policy. We respond to valid DMCA notices and maintain a repeat-infringer policy. The Service should not be used to circumvent licensing terms imposed by publishers, assessment vendors, or content providers.
